1.1 www.chalab.co.uk and associated subsites and subdomains (together the "Website") are operated by Jimmyco LTD (that's who we mean by "Cha Lab", “JIMMYCO LTD”, "we, "us" or "our").
1.2 We're a company registered in England and Wales with company number 10184422. Our registered office is 11 ST PETERS STREET, CANTERBURY, KENT, CT12AT.
2. What are these terms and conditions?
2.1 These terms and conditions (the "Terms") govern any and all use of our Website. These terms apply to any user of our Platform ("you", "your").
2.2 We refer to the Website in these Terms as the "Platform".
2.3 You should be aware that, although these Terms apply to everyone who uses our Platform, there are other terms and conditions, policies and notices which might also apply in addition to these Terms. Depending on your particular use of our Platform, goods and services, these might include the following (together the "Other Terms"):

3.3 By using the Platform you are fully accepting the terms, conditions and disclaimers contained in these Terms. If you do not accept these Terms you must immediately stop using the Platform.
4. Advice and Information
4.1 The contents of the Platform do not constitute advice and should not be relied upon in making or refraining from making, any decision.
4.2 We try to ensure that the information on our Platform is accurate and complete but we can't guarantee this.
4.3 We try to make relevant allergen and nutritional advice available throughout our Platform, but because our ingredients are so fresh and change regularly, we encourage you to consult our allergen guide and staff in the usual way before placing any orders or consuming any of our products. If you have any particular allergy or other health concerns, we recommend that you check the allergen guide regularly, and before each order here on or in our physical store. We can’t guarantee any of our products will be suitable for those with allergies due to a high risk of cross contamination. Our vegan products are made to a vegan recipe but are not suitable for those with dairy and egg allergies. Your health and wellbeing is our number one priority, so if you have any questions on our ingredients or produce, please do ask in store.
5. Changes to the Platform and T&Cs
We reserve the right to:
5.1 change or remove (temporarily or permanently) the Platform or any part of it without notice, and you agree that JIMMYCO LTD shall not be liable to you for any such change or removal; and
5.2 change these Terms at any time, and your continued use of the Platform following any changes shall be deemed to be your acceptance of such change.
6. Links to Third Party Websites
6.1 The Platform may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
7. Intellectual Property Rights
7.1 All copyright, trademarks and all other intellectual property rights in and to the Website are owned by or licensed to JIMMYCO LTD or otherwise used by JIMMYCO LTD as permitted by law.
7.2 In accessing the Platform you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without our prior written consent. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.
8. Personal Data
8.1 We will only use your personal information as set out in our Privacy Policy.
9. Disclaimers and Limitation Of Liability
9.1 The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied. Without prejudice to the generality of the foregoing, we do not warrant or represent that the Platform will be of satisfactory quality, fit for a particular purpose, non-infringing, compatible with any other software or hardware, secure or accurate.
9.2 To the extent permitted by law, JIMMYCO LTD will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Platform.
9.3 We make no warranty that the functionality of the Platform will be available, uninterrupted or error free, that defects will be corrected or that the Platform or the servers that make it available are free of viruses or other harmful code.
9.4 Nothing in these Terms or the Other Terms shall be construed so as to exclude or limit the liability of JIMMYCO LTD for death or personal injury as a result of the negligence of JIMMYCO LTD or that of its employees or agents, and shall not limit or exclude any of your statutory rights as a consumer.
9.5 You agree that some features and functionality of our Platform may also be dependent on your device, internet connection, browser, settings and permissions. For example, if you don't allow us to use cookies or similar technologies, then you might not be able to use certain features and functionality that rely on those technologies; and if you don't allow our website/app to use your location, we won't be able to deliver location-based services.
10. Indemnity
10.1 You agree to indemnify and hold JIMMYCO LTD and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against JIMMYCO LTD or its subsidiary sites arising out of any breach by you of these Terms or the applicable Other Terms, or other liabilities caused directly or indirectly by your use of the Platform.
11. Severance
11.1 If any of these Terms should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Terms shall be severed and the remaining Terms shall survive and remain in full force and effect and continue to be binding and enforceable.
12. Governing Law
12.1 These Terms and any related dispute or claim (whether contractual or non-contractual) shall be governed by and construed in accordance with the laws of England and Wales and you agree to the jurisdiction of the Courts of England and Wales in relation to any such dispute or claim. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.
Loyalty Terms and Conditions
- Earn 1 stamp for every full price drink purchased.
- Collect 9 stamps or otherwise stated on your current Cha Lab Loyalty Card to receive any Regular drink free upon your next visit (Excludes additional toppings).
- No stamps will be issued on any promotions running in any Cha Lab store.
- This stamp card can only be used at Cha Lab.
- Stamps and rewards cannot be exchanged, refunded, replaced or redeemed for cash.
- Cards are non-transferrable and cannot be combined with other cards.
- Cha Lab reserves the right of final decisions in case of any disputes.
- By using the stamp card you are fully accepting the terms, conditions and disclaimers contained in these Terms. If you do not accept these Terms you must immediately discard the loyalty card.
Promotion Terms & Conditions
Below are Terms and Conditions for the current Student Discount Offer running in store Only:
- All full price drinks are subject to a 10% discount. Excluding extra toppings.
- All other extra toppings except what is standard for the above drinks is to be paid by the customer.
- No other on-going offer or promotion can be applied to this sale of these drinks, i.e. stamp cards or other discounts.
- The offer is valid until supplies last or until we notify of such change how we deem as appropriate. We will amend the prices displayed in store accordingly when and such change happens.
- We reserve the right, at our sole discretion, to modify or replace the above mentioned terms at any time.
Privacy Policy
Chā Lab takes your privacy seriously. We don’t share any information you provide us with any third parties (although if you place an order with us through a third party like an order website they may store some of your data; please check their privacy policy for more details).
When you order online from the Chā Lab Web Portal or register your details on the website, your name and email address are stored on our system, along with your purchase history. If you order a product online we will also save your postal address (so we can send your products out for delivery) and phone number (to contact you in case of any problems or to sort out a bespoke delivery time). We don’t store your credit card information.
If you register with us online (or opt in when you order a product) you may start receiving our email newsletter in the event that we enable such a feature. We try our best to make our emails informative and fun. They include news about upcoming events, special or seasonal offers and facts about YiFang, our products and heritage. We normally send only one email out per week. There’s an “Unsubscribe” link at the bottom of every email we send out – click that to remove yourself from our mailing list.
Changes to this Privacy Policy
We may update our Privacy Policy from time to time.
You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

Delivery/Collection Policy
- After placing an order for Click and Collect we will process your credit or debit card for payment. As soon as we have received authorization for the payment from your card provider, we will begin to process your order through our system and we will send you an email acknowledging receipt of your order. We cannot issue a refund once the order is made. The contract between us will only be formed when we send you such confirmation.
- The price payable for the Order is as set out on our site at the time you submit your order.
- Please check the order pick up location as we cannot alter the location once the transaction is completed.
- Customers must collect the order on the same day as the order placed. Any uncollected orders will be discarded.
- We reserve the right to update prices in future which will then supersede the prices in any catalogue or on our site.
- Occasionally, an error may occur and Products may be either incorrectly priced or described in which case we will not be obliged to supply the Products at the incorrect price or in accordance with the incorrect description or at all. We reserve the right to correct any errors from time to time. We will (at our discretion) either cancel your order for Goods and refund the price you have paid or use reasonable endeavours to contact you and ask you whether you wish to continue with the order for the Products at the correct price or correct description.
- The images of the Products on our site are for illustrative purposes only. Although we have made every effort to display the products accurately, we cannot guarantee that your computer’s display of the colours accurately reflects the colour of the products. Your Products may vary slightly from those images. Although we have made every effort to be as accurate as possible, all sizes, weights, capacities, and colours.
- We must receive payment for the whole of the price of the Products you order and purchase before your order can be processed. Order payment can be made by most major credit or debit cards, by completing the relevant details on the checkout page.
- By using a credit/debit card to pay for your order or purchase, you confirm that the card being used is yours or that you are authorised to use it.
- All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of the card refuses to authorise payment we will not accept your order or purchase, we will not be obliged to inform you of the reason for the refusal, and we will not be liable for the Products not being provided to you. We are not responsible for the card issuer or bank charging the holder of the card as a result of our processing of your credit/debit card payment in accordance with your order or purchase. We recommend that you do not communicate your payment card details to anyone, including us, by email.

Refund Policy
Terms below give guidelines to refund policy when items are purchased IN STORE:
Drinks may only be refunded if:
- They have not yet been made.
- You were given an incorrect one or if it's missing/has incorrect items.
- Out of stock items at the time of preparation.
Should the beverage be unsatisfactory to you in any way, please let us know as soon as possible whilst in store. You are responsible for informing staff of any allergens you might react to.
Due to the nature of our business, we are unable to refund beverages that already left the store.
Terms below give guidelines to refund policy when items are purchased ONLINE COLLECTION SERVICE:
For your satisfaction, we ensure that you always get pickup drinks according to your requirements. If for any reason you’re unsatisfied, we encourage you to contact the store.. Preparation of your order can begin immediately after your order has been confirmed.
We’re very sorry, we cannot cancel, refund or give store credit if you change your mind or mistakenly order an item after the order is prepared. We cannot provide any refund or accept cancellations for our beverages.
In the likelihood of an out of stock product, we can provide refunds or exchanges. If you receive drinks that are different from your receipt, we sincerely apologise and we will provide you with the right order.
Age Policy
There are no age restrictions known to Chā Lab at the time posting this policy.
If such policy or governing law is available to us we will make all necessary changes to reflect that in this policy.
However, we do advise customers that our beverages may contain small toppings that may be a choking hazard to younger children under 5.
Chā lab reserves the right to amend any policy at its own discretion. Please review this policy constantly for your information.
